Summa’s law suit refused

The ninth Arbitration Court of Appeal has refused the claim of the Federal Supervisory Service on Communication, Mass Media and Culture Protection (Rossvyazohrankultura) against the adjudication of the district court to impose interlocutory injunctions regarding the Summa Telecom’s law suit.

The Federal Antimonopoly Service was taken to court on request of Rossvyazohrankultura. Last December Summa Telecom claiming to acknowledge invalid Rossvyazohrankultura’s tenders for GSM licences in the Russian regions held in summer forced to ban licence granting to the tender winners under the interlocutory measures.

However, the companies that received most licences during the tenders — SkyLink and Tele2 subsidiaries — managed to receive the licences until the interlocutory measures were imposed. The district court adjudication having been approved by the court of appeal, Summa Telecom will seek to execute the adjudication if any of last year’s tender winners tries to use its licences.
